Review of PPP Policies for the Ministry of Economic Development in Mongolia
Project Overview
In response to the newly enacted Public-Private Partnership (PPP) law, the Ministry of Economic Development (MED) of Mongolia identified the need to develop comprehensive PPP policies. These policies were essential to ensure effective implementation, regulatory compliance, and to attract private sector investment. The project, supported by the Asian Development Bank (ADB), was awarded to Cybiant due to its extensive expertise in policy development and Public-Private Partnerships. Over a six-month period, Cybiant successfully developed and reviewed nine critical PPP policies, providing a robust framework for Mongolia’s economic growth and development.
Client Background
The Ministry of Economic Development (MED) of Mongolia is responsible for formulating and implementing policies related to economic planning, development strategies, and investment promotion. With the enactment of the new PPP law, MED required specialized support to develop policies that would foster a conducive environment for public-private partnerships.
Objectives
- Review Nine PPP Policies: To establish a comprehensive set of policies aligned with the new PPP law to guide the planning, execution, and management of PPP projects.
- Ensure Compliance and Best Practices: To align the policies with international best practices and ensure compliance with legal and regulatory requirements.
- Promote Private Sector Engagement: To create a transparent, reliable, and attractive framework for private sector participation in public infrastructure and services.
Scope of Work
The project was structured into several key phases:
- Initial Assessment and Planning: Cybiant conducted a thorough assessment of the existing legal framework, PPP law, and MED’s strategic objectives. This phase included stakeholder consultations and a gap analysis to identify areas of focus.
- Policy Development: Based on the initial assessment, Cybiant drafted nine comprehensive PPP policies. These policies covered areas such as project identification and prioritization, feasibility studies, risk management, procurement procedures, contract management, performance monitoring, dispute resolution, and capacity building.
- Review and Refinement: The drafted policies underwent a rigorous review process, incorporating feedback from MED, ADB, and other key stakeholders. This phase ensured that the policies were practical, enforceable, and aligned with international standards.
- Capacity Building and Training: Cybiant provided training sessions and workshops to MED officials and relevant stakeholders to ensure effective implementation of the new policies. This included practical guidance on policy application and compliance monitoring.
Outcomes
- Successful Policy Development: Cybiant successfully developed and reviewed nine PPP policies, providing MED with a Successful Policy Development: comprehensive framework to guide PPP projects.
- Enhanced Capacity: The training and workshops enhanced the capacity of MED officials to implement and manage PPP projects effectively.
- Increased Private Sector Confidence: The clear, transparent, and robust policy framework boosted private sector confidence in engaging with PPP projects in Mongolia.
- Alignment with Best Practices: The policies were aligned with international best practices, ensuring that Mongolia’s PPP framework met global standards and attracted quality investments.
Conclusion
Cybiant’s expertise in policy development and commitment to best practices played a pivotal role in the successful completion of the project. The collaboration with the Ministry of Economic Development and the support from the Asian Development Bank were instrumental in achieving the project’s objectives. The development and review of the nine PPP policies have positioned Mongolia to effectively leverage public-private partnerships, fostering economic growth and infrastructure development.
